PROVISIONS APPLICABLE TO ORDERS PLACED AND CONTRACTS CONCLUDED
Acceptance of these General Terms and Conditions
By placing an order on the Site, the user or customer will be asked to fully and unreservedly accept these General Terms and Conditions of Sale, which alone shall govern the contract concluded.
Ordering – Payment and Contract Conclusion
The Site contains at all times a commercial invitation to purchase products, which is not legally considered a permanent binding offer. Packaging and shipping costs can be viewed at any time by checking the shopping cart; these costs are sliding-scale based on the total order amount.
How to order and pay:
- Online: On the website www.atelier-argoat.fr, 24/7, via secure online payment or bank transfer.
- By mail: By sending your check made payable to Atelier de l’Argoat.
As detailed below, the conclusion of a contract will only occur upon order confirmation by Atelier de l’Argoat.
After payment validation and in accordance with the general obligations outlined herein, the order deemed accepted by Atelier de l’Argoat will be confirmed to the user via email.
Acceptance or, if applicable, refusal of an order will be confirmed to the customer no later than 48 hours after receipt of the order, subject to full payment. In the case of orders sent by mail or fax and paid by check in Euros, order acceptance will only take place upon receipt of the check at our offices.
Atelier de l’Argoat further reserves the right not to process a payment and consequently not to confirm an order for any reason whatsoever, particularly regarding product supply issues, irregularities in the order received, or foreseeable delivery complications. Customers cannot cancel their order once it has been validated.
Prices – Shipping & Packaging Costs – Invoicing
The total price indicated in the order confirmation issued by Atelier de l’Argoat is the final price. This price includes product prices, French taxes, packaging, and shipping costs.
Your contribution to packaging and shipping costs is established as follows:
- For delivery in mainland France, costs range between €0 and €12 (incl. VAT), depending on the order amount.
These sliding-scale costs can be consulted at any time in the shopping cart.
General Obligations of the Parties
Obligations of Atelier de l’Argoat:
Atelier de l’Argoat undertakes, following order confirmation, to sell and deliver the ordered products to the online customer. Should products be temporarily unavailable, Atelier de l’Argoat will inform the customer to decide whether to maintain or cancel the order. Atelier de l’Argoat has entered into a contract with its carriers: CHRONOPOST and CHRONOPOST INTERNATIONAL, under which the carrier agrees to deliver products to the address provided by the customer.
Atelier de l’Argoat will make every effort to ensure that photographic representations of products or services on the Website are as accurate as possible. However, given the digital presentation mode on the Internet, the customer's perception of product photos may not perfectly match the actual product.
Customer Obligations:
The customer agrees to provide Atelier de l’Argoat with a delivery address where delivery can be executed during business hours.
Data Protection and Privacy
In accordance with the Data Protection Act (Loi Informatique et Libertés) of January 6, 1978, the Customer has the right to access and rectify personal data stored by Atelier de l’Argoat.
To exercise this right, simply send an email to: contact@atelier-argoat.fr.
Data Confidentiality
All personal details left on the site (name, email, etc.) will be strictly used for the business activities of Atelier de l’Argoat and will not be rented, sold, or shared with third parties.
Transport – Delivery – Delivery Lead Times
Orders received on day 'D' will be shipped the following day (with the exception of orders placed between Saturday and Sunday, which will be shipped starting the following Monday), provided payment clearance has been approved.
Products are then transported from Tuesday to Saturday by our carrier.
Products are delivered to the delivery address specified in the order within 1 to 3 business days from order confirmation, unless payment has failed for any reason. Delivery addresses (home, office, etc.) can differ from the billing address.
For delivery addresses located in Mainland France (including Corsica) and Monaco, our partner CHRONOPOST will deliver the day after shipment.
Once the parcel is handed over to CHRONOPOST, the customer will be notified by email and provided with a tracking number. Throughout transit, customers can track their package using the tracking number on the carrier’s website (http://www.chronopost.fr) or by clicking the link sent by email on the day of dispatch.
Similarly, Chronopost will send an SMS or email informing you when the package is out for delivery, allowing you to reschedule delivery, select a nearby pickup point, or update the delivery address.
In the event of absence of the recipient or authorized recipient upon delivery, the carrier will leave a delivery notice inviting the customer to collect the products at a pickup point. Under no circumstances shall Atelier de l’Argoat be held liable for any deterioration of products resulting from late pickup or failure to collect the package.
Delivery estimates provided by Atelier de l’Argoat vary by country. These are for indicative purposes only, and exceeding them does not entitle the customer to cancel the order. Furthermore, Atelier de l’Argoat shall not be held liable for any indirect damages claimed by the customer, including loss of income, profits, interest, or business opportunities resulting from delayed delivery. Atelier de l’Argoat’s liability shall in any event be capped at the total order amount.
Transfer of Ownership – Transfer of Risk
Products travel at the risk of Atelier de l’Argoat. The transfer of risk regarding loss or damage to products takes place upon signature of the delivery receipt by the Customer.
Delivery Delays: For France and the European Union, the Customer has the right to cancel the order if delivery has not occurred within three business days following the dispatch date indicated by Atelier de l’Argoat, unless the delay is caused by a force majeure event as defined by French legal precedents.
Execution of Delivery: Deliveries are deemed executed once the product or service is made available to the Customer by the carrier, as evidenced by the carrier’s tracking system (such as Chronopost's online tracking system).
Reservations upon Receipt of Products – No Returns – Limited Refund / Replacement Cases
Customers may only express reservations upon delivery in cases of quantitative non-conformity or if the packaging containing the products is severely damaged. These reservations must be made in writing to the carrier upon delivery, or at the latest within 3 business days following receipt. A copy of these reservations must be sent to Atelier de l’Argoat (via email, fax, or mail). The customer must provide Atelier de l’Argoat with carrier confirmation supporting these claims.
If the parcel has been resealed with carrier tape, explicit reservations must be recorded with the carrier.
No returns of products will be accepted.
If the above procedure has been followed and it is proven that reservations are due to severe damage to the packaging and products, Atelier de l’Argoat will, at its discretion, refund the paid price or dispatch a replacement order of equivalent products.
If the delivery is quantitatively non-compliant, Atelier de l’Argoat will refund only the price difference between ordered and delivered items (provided delivered items are of lower value). No reservations or claims will be accepted regarding the taste, appearance, or color of products.
Warranty – Limitations
Atelier de l’Argoat warrants that the products are made in France (in Brittany) and have been crafted with all necessary care to ensure compliance with the descriptions on the website at the order date. Atelier de l’Argoat also warrants that products are of premium quality and fresh when handed over to the carrier. This constitutes the sole warranty provided by Atelier de l’Argoat. No other express or implied warranties are given. In particular, Atelier de l’Argoat cannot guarantee that products will meet individual customer expectations. Product photographs are non-contractual and served for illustration purposes only, as minor color/aspect variations may occur due to digital image processing.
Liability – Limitation of Liability
The customer is solely responsible for product selection, storage following delivery, and consumption. Customers are reminded not to consume products beyond the expiration dates indicated on labels, nor if products appear deteriorated (due to heat, transit issues, or any other cause). Atelier de l’Argoat shall not be held liable for any damage resulting from improper handling or consumption. Furthermore, Atelier de l’Argoat cannot be held liable for non-compliance with laws or regulations in force in the country of delivery, as Atelier de l’Argoat is strictly subject to French regulations governing food products. In any case, regardless of the cause of action, Atelier de l’Argoat's liability is strictly limited to the lower of the following two amounts: the direct damage suffered by the customer or the total order price.
Right of Withdrawal
In accordance with Article L. 121-20-2, 3° of the French Consumer Code, and given the perishable nature of food products sold on www.atelier-argoat.fr, no right of withdrawal is available to the customer.
Severability – Force Majeure – Applicable Law – Jurisdiction
Should any provision of these General Terms and Conditions be declared unenforceable or invalid for any reason, such invalidity shall not affect the validity or application of the remaining provisions, and the invalid clause shall be replaced by a valid provision closest in intent.
Atelier de l’Argoat shall not be held liable for non-performance resulting from force majeure events beyond its control, including but not limited to war, riots, insurrections, transport disruptions, import/export issues, strikes, lockouts, shortages, fires, earthquakes, storms, or floods.
The parties agree that this agreement is governed exclusively by French law, and that French legislation and the French language shall strictly prevail.
In the event of a dispute and failing an amicable agreement, French courts shall hold sole jurisdiction.
